The Basics of Builders’ Liens: Rights, Registration and Reality

This program will provide an introduction for junior lawyers or those interested in learning more about the area. This session will consider lien “basics”, including:

  • The general purpose of the Builders’ Liens Act
  • Creation, perfection and expiry of lien claims
  • Priority of lien claims
  • Discharge of liens (from a variety of perspectives)
  • “Piggy back” lien claims

In addition to reviewing these basics as they pertain to lien claims, situations leading to claims for breach of trust will also be discussed in conjunction with the relevant sections of the legislation relating to those claims.
