Amendments to Probate Rules 74 and 75

Changes to probate rules 74 and 75, which deal with probate practice and contested estates, came into force on October 1, 2022. Please click here to view the June 16, 2022 Court of Queen’s Bench Notice.

The amendments, along with new forms, are intended to modernize the language in these rules and to make the probate and administration application processes easier to understand. This program covers what’s different and what’s new, including:

• A walk-through of the 3 main types of application: probate; administration; administration with Will annexed
• Less common applications, e.g. double probate
• Establishing proof of death
• Desk order for lost Will
• What to anticipate if you are counsel involved in a contested estate
• The new forms
